WHY DO I NEED A PRIVACY AND COOKIE POLICY?


If you collect personal data about your users via your website or app, then you must, by law, tell your users what you do with that information, why you need it and how you look after it.

If you have privacy and cookie policies already, then these will need to be updated once the EU General Data Protection Regulation (GDPR) comes into force on the 25th May, 2018. The GDPR includes specific rules about the way in which you must provide information to the people you collect personal data about. The GDPR also introduces legal accountability on companies which must take ‘appropriate measures’ to comply.

Personal Data does not only mean email addresses and names. It means any information relating to an identifiable natural person such as name, location information or online identifier. In other words, although you may not knowingly be collecting personal data, your website still is. In order to provide your users with access to your pages, images and files, your website needs to collect IP addresses as a minimum.
Put simply, if you have a website, then you are collecting personal data.

What’s more, the personal data you collect will vary depending on the nature of your services. The data you collect will then be processed in various locations depending on what third party services you use such as PayPal, Stripe, Mailchimp, Xero or a virtual assistant based outside the UK.

Your policies must be tailored to your business so copying from another website will not be sufficient.


WHY DO I NEED WEBSITE TERMS AND CONDITIONS AND AN ACCEPTABLE USE POLICY?


As a website owner, you spend an incredible amount of time and money creating your website content and perfecting your branding. Your website terms and conditions will clearly state that your website is your intellectual property. It will also say that you do not accept liability for any inaccuracies or outdated information that you have on your site as well as warn users not to hack or damage your site through your Acceptable Use Policy. Although these documents are not required by law, they are very much needed to make sure that you are being clear with your users and setting the right tone in terms of how your site may and may not be used.

These are your commercial terms. They outline your relationship with your users, how sales are made, what your refund policy is, what happens in the case of a dispute and who to contact if there are any complaints. Your Terms of Service will be the backbone of how your business is conducted and not being clear or transparent could make or break your business. This document is imperative for the success of your company.
